Abstract
According to the regulations of Criminal Law,instigation to crime is a sub-concept subordinate to the joint crime,therefore it is criminated as the joint crime.But practically,not all instigations to crimes are the joint crime,thereby the research of the attempted crime pattern should be based on the instigation to crime with the divisions of the independent and the conjunct.Moreover,because of the separation of theory and practice,the punishment principles of the Criminal Law lack rationalities,which disobey the Criminal Law's basic principles and also indulge the crimes.From this perspective,this thesis redefines and illustrates the attempted crime pattern of the instigation to crime.
