Abstract

The author holds that the of real right of our country may not adopt the theory of real right behavior,but can not put the existence of the real right behavior ignoring.Real right behavior is objective.Its foundation and force are applicable to general rule of juristic act,but it also has its own characteristics.We Cannot deny real right behavior existing independently regardless of its cause.The author puts forward suggestions in detail on amendment of law of real right(draft),which are fresh and exercisable.
