Abstract

Administrative Dispute is the core concept of the system of administrative litigation. It is what administrative litigation different from civil proceedings and criminal proceedings. How to define administrative dispute is a basic question in theory on administrative litigation. Administrative dispute is a kind of dispute happens between administrative body and the private party when administrative body exercising its public power. Administrative dispute can be resolved through public law. When deciding whether a dispute is an administrative dispute, such factors should be considered as the body, public power, public interests, etc.
