Abstract

Provisions on Some Issues Concerning the Exclusion of Illegal Evidence While Handling Criminal Cases have creative significance in defining illegal verbal evidence,excluding the credibility of illegal evidence,distributing burden of proof and establishing the criterion of proof.However,it actually exerts limited exclusion of illegal evidence for it does not involve illegal material evidence and its exclusion.In addition,the procedures of excluding illegal verbal evidence are inexhaustive.Therefore,it is necessary to improve the above-mentioned provisions.
