DISCUSSION ON THE METHOD OF INDEMNITY AND STANDARD OF CALCULATION OF THE STATE INDEMNITY LAW

Based on the newly revised State Indemnity Law,this paper probes into the remaining problems such as failure to embody state liability of indemnity,highest indemnity restriction,and inaccurate definition of indemnity methods and calculation standard for mental damage,etc.Such regulations may lower the satisfaction of sufferers and also increase the application of negotiated indemnity.Therefore,the authors suggest that Article 32 to 36 of the State Indemnity Law be improved further in due time.
