"Opinion Judgment" or "Media Judgment" ?——An Analysis of the Idea and the Solution to the Problem

It is unnecessary for scholars today to differentiate between opinion judgment and judgment and discuss them accordingly.From the point of view of consensus study and jurisprudence,there are not fundamental distinctions between them.There behind the judgment is the conflict of two different ideas: liberty of speech and independence of judicature.In China,these two values deserve to be protected,so effective methods should be adopted to ease the tension between liberty of speech and independence of judicature,and thereby a harmonious relationship between judicature and media will be built.
