There exists a considerable content gap between the TRIPs Agreement and China's criminal law on crimes against copyright, in terms of criminal subjective elements, objective elements, statutory sentences and the handling of infringing duplicates. We should refer to the related stipulations of the TRIPs Agreement when improving our criminal law on crimes against copyright.
