Although our criminal procedure law doesn't prescribe this principle clearly, some relevent laws has embodied its spirit, but it has serios defects in witness paticipating criminal procedure and using patrol evidence's scope, and it can't embody the important value of the principle of direct trail and verbal trail. Analyzing original and value of the principle, according to our country's practice and the world's trendency, we should set up the principle in our country and accept some feasible suggestions.
