On Reform of Civil Litigation Procedure and Model in China——From the Model Selection to the Procedure Improvement

With growing of near modern market economy and complexity of social relations,the traditional dispute solution way and social adjustment mechanism will not meet the needs of society.Legal specialization and professionalism will be historical necessity.In the Western law tradition,the legal execution was entrusted for group of special people;they more or less were engaged in the legal activity professionally in professional foundation.Since the 1960s,the numerous countries and areas have started to amend the civil procedure law and to change the pattern and procedure of civil litigation.On one hand,this change will help to bring the parties to facilitate participation in the proceedings through a set of litigation to resolve disputes;the other hand,it will effectively improve the utilization of judicial resources and make lawsuit popular,common.
