Improvement of Exclusion Rule of Illegal Evidence in Criminal Procedure

Exclusion rule of illegal evidence has been established in China,but the broader law results in difficult operation in practice.Scientific and rational exclusion rule of illegal evidence should not only meet the need to combat crime.but also protect the legitimate rights and interests of citizems.We should establish a preventive mechanism to prevent illegal evidence from coming into being,make clear proof rules of illegal evidence collection ways and exclusion of illegal evidence,set up relief mechanism of exclusion rule of illegal evidence,and improve the disciplinary system towards the personnel collecting evidence illegally.
