The Phenomenon of Hacker and its Implications in the Legal Culture

The problem of hacker is the result of the network era.It constitutes a new research project for scholors who major in law.The article has generalized various definitions about hacker and pointed out that hacker is not a destroyer but an invader.Then the article has depicts the historical development of hackering from a special legal perspective and analyzed the five characteristics of hacker phenomenon in China:for the sake of network safety ;emphasizing obeying law;emphasizing culture construction;the outstanding red-hacker and the increasing hacker crime.Based on this view,the article further purifies the significance of the phenomenon of hacker in the following three aspects:basic legal concept;legal value judgment;legal mode of regulation.
