Abstract
Public property means the property that is managed directly by the administration for the purpose of guarding and promoting social and public interest. Public property has two categories: official affair property and welfare property. The former is furnished to administrative institutions or the staff therein to conduct official affairs; while the latter is contributed to the public for their life or production. While public property is managed by the state,local governments or public corporations,the estate therein or thereto falls within the ambit of public law,which is quite different from that in private law. To some extent,the Propositional Version for Draft of the Act of the Real Right confuses the legal characters of the ownership of public property.
