Abstract
Based on the concept of liberty,the evaluative liberty of liberty penalty is that criminal do what he wants for achieving his need without others' obstacle.Due to the development of the society,the evaluative liberty has been limited in narrow liberty finally after it's division.In different countries of different stages of development,the liberty of liberty penalty is different also.
