Abstract
Peasants' problem has been the most constraining factor for national economic and social development.The ultimate problem is the problem of rights.Because of the special characteristics of Chinese peasants,their rights can mainly be divided into two categories,that is,the land rights as professional peasants and the equal rights as identity peasants.The infringement and negligence caused by mis-operation or misuse of state power might lead to the implement of a series of laws and regulations discriminating and sacrificing peasants' benefits.The oppression of the whole social environment on peasants may finally reduce them to the vulnerable groups with poor rights,remaining on the margins of society.So the key to solve peasants' problem is to limit the state power and to demonstrate the peasants' rights.
