Abstract

This article focuses on the discussions of the principle of compatibility of crime, responsibility and penalty in Article 5 of our new criminal law. The writer elaborates on the relevant issues of “ the harshness of criminal penalty from the perspectives of “ crime committed and “ criminal liability and proposes that expounds the framework of balanced relationship among crime-responsibility-penalty redefined on the basis of criminal responsibility.
