Abstract
It's not appropriate to define the legal status of China's public colleges and universities by using the Authorized Theory or the Theory of the Official Legal Person.As the main structural factors of the modern society,the Third Sector is able to cover the inadequacy of the traditional government mechanism and the traditional market mechanism,and to realize the optimization of the educational product configuration.Based on the relationship between the public universities and students and the pre-public nature of the educational products,the universities in China should be considered as the Third Sector.
