Law Evolution of Obligation of Cohabitation and Proposed Amendments for Our Marriage Law

Abstract

Through the law evolution of the obligation of cohabitation,we find out some reasons why obligation of cohabitation has not been provided in Chinese Marriage Law.The status quo that many countries stipulated the obligation of cohabitation in their family law makes us rethink this problem.Legislation should inject the obligation of cohabitation of spouse,the exemptions of obligation of cohabitation and the legal obligations of cohabitation responsibility into our marriage law.
