Abstract
The protection of intangible cultural heritage will favors the preservation of cultural diversity and the promotion of traditional Chinese culture,it has been paid more and more attention in China in recent years.The law protection is discussed widely,there are two main ideas,one is new civil right,the other is intellectual property right,but all are devoid of maneuverability.The protection of intangible cultural heritage need based on reality and specifically analyze,we should distinguish intangible cultural heritage and its derivatives,pay attention to the positive protection and also to the defensive protection,and this will help to develop,utilize,and protect intangible cultural heritage.
