Abstract

In recent years,mental damages have been the central issue and difficulty in jurisprudence and the judiciary,but the research topic on relevant laws and regulations of China reflective review.Establish and improve the mental damage compensation system,is from the need to maintain rights,also a necessary prerequisite for their spirit of the interests of rights holders.The damages of mental subject,object and determine the unclear,non-specific,imperfect scope of mental damage compensation regulations is not conducive to the operation of judicial practice.
