Abstract
This article presents an opinon that the reform the conventional obligee's subrogation isn't successful.Compensated directlydamages the relativity and the equality of creditor's right, and it can't merge into the civil action. The obligee's subrogation has been declining in modern times. Our country should draw lessons from the foreign experiences. The obligee's subrogation can be taken place by a perfect execution in subrogation.
