Abstract

The rights of mineral resources include all the rights resulting from the mineral resources.The ownership belongs to the nation.The right of prospecting is neither a property right nor an intellectual property,but a mixed right of the creditor's rights and the administrative rights.The right of mining is a sort of the qualified right in rem,and it contains usufructuary right and security interest.Our system of the rights of mineral resources comprises the national ownership and the right of mining.The right of mining also has branches with certain usufructuary right and security interest.
