STUDY ON POWER ALLOCATION IN THE POST-PROCEDURE OFCRIMINAL TRIAL

Abstract

The post-procedure of criminal trial includes a series of procedures after the entry into force of judgment,viz.the implementation of criminal procedure,the victim protection procedure,the procedure of abolition of crime record etc.and does not include trial supervision procedure.In order to remedy the defects of decentralization and the unclear responsibility in the post-procedure of criminal trial in China,it is supposed that the administrative organization of justice exercises unified criminal executive right,and the people's court exercises jurisdiction in criminal execution,the jurisdiction of abolition of crime record and perfects the victim protection system in the post-procedure of criminal trial.
