On the Legal Character of Labor Contract

Abstract

Labor contract is the result of the socialization of employment contract in Roman Law. Law relationship in it is interfered by state power to some extent, but still belongs to private relationship. In this sense, the future civil code of the PRC shall provide employment contract chapter in contract section act as the basis of labor contract institution so as to solve the application difficulty in academic and practical respect.
