Agreement on Trade-Related Aspects of Intellectual Property Rights and Protection of Trade Secrets in China

The status of trade secrets is confirmed as 'undisclosed information' in the Agreement on Trade-Related Aspects of Intellectual Property Rights(TRIPs),and accordingly,members of TRIPs are asked to protect the trade secrets.Although the history of the protection of trade secrets is not long in our country,it has experienced large development recently.The development,however,is not adequate enough.From the rules of TRIPs and circumstances in our country,this article is aiming at an analysis and discussion on the elements,nature of the right,protection of legislation and justice regarding trade secrets,and gives some suggestions at last.
