The basic trains of thoughts in the scientific research of legal history in China of the 21~(st) century

The scientific research of legal history in China of the 21 st century faces new problems and challenges of the new era.We must,in the background of globalization,examine China's scientific research of legal history,change the train of thought in research,pay close attention to the modernization and globalization of legality and the influence of the post-modern ideological trend upon the scientific research of legal history.We must expand the range of objects of study—from simplified to complex—in order to combine system with thought,history of law as a whole with history of branch law,and have a thorough knowledge of history and reality,law on paper and law in practice.We must also continuously renew our methods of research—from oversimplified to deversified.We must widely adopt reasearch methods of jurisprudence and sociology of law on the basis of historical method.In addition,we must stress the dynamic investigation and comparative analysis of legal history so as to promote the scientific research of legal history in China and thus entrust new epoch-making significance and practical value to the scientific research of legal history.
