Criminalization and Decriminalization in the Perspective of Temper Justice with Mercy——From standards on the Quality of Handling Non-prosecution Cases by supreme people's procuratorate

Criminalization and decriminalization are certain facts in the development of society.In China they both are based on realistic consideration.According to criminal policy of temper justice with mercy and the construction of harmonious society,both criminalization and decriminalization should be considered synchronously.On one hand,making the net of justice strict;on the other hand,keeping tolerant of the slight crime.As a result of the social condition in the transition period,criminalization will go on.Decriminalization by judicial practice is the main route of decriminalization in China.The standards on the non-prosecution cases just do this way.
