Abstract

On attributes of private international law and domestic law, academic community put forward diverse assertions : international law theory, domestic law theory and dualist approach. Private international law is supposed to take on attributes of both international law and domestic law. To determine this point is beneficial, not only for unified private international law to come forth and come to perfection, but also for breaking away from the traditional misconception and coming up to a optimal balance between national sovereignty and the international system.
