The nature and legal position of the university and college education institution in ching is a basic problem of Chinese higher education system.It involves in the responsibility and duty of the educational subjects such as the Government,universities,teachers and studenlents as well as the concerned relations.It also is the premise for us to look into the legal disputes and self-control rights of these institutions.Comparing these institutions between at home and abroard,through an analysis,this essay put forth suggestions and countermeasures to make perferct the nature and legal position of the institutions.
