Abstract

The essay systematically discusses the fundamental theories of the system of possession. Based on this, the author suggests that we should establish the system of possession to correct its status in the Civil law at first. Then, the author believes that the absence of the system of possession in the Chinese Civil Law is a serious deficiency, insists that we should absorb and make better use of the foreign relevant theories, and found a particular property system in the Chinese Civil Law which is set up on the core of property-possession.
