Foundation on which responsibilities of contracting negligence relies is honest credit principle, whose impor- tant document is that a behavior person violates first contract duty to opposite side and causes losses relying on benefits, whose behavior both has cause and effect with opposite side between the losses and is wrong.As for taking responsibili- ties of the contracting negligence, foreign judicial practice experiences should be borrowed in order to establish a damage compensating principles in which relying benefit does not exceed undertaking benefit, and responsibilities of contracting negligence are balanced.
