Abstract
Because of its nature as private property and its function of adjusting civil relationships,intellectual property belongs to the category of civil rights.Accordingly,general provisions regarding intellectual property should be given in the civil code of China,and meanwhile the relevant special laws should be preserved and improved so as to establish the legal system regarding intellectual property.
