Abstract
There have two theories about the legal relation between universities and students,they are special power relation and civil plus administrative relation.Current legal relation between universities and students in China belongs to the latter theory.However,the special power relation has strong influences in many universities when they deal with some administrative affaires.Based on the analysis of the reasons of the more and more legal imbroglios between universities and students,the new legal relation between universities and students in 21st century was brought forward.
