Abstract

Under the current legal framework and traditional ideas,incidental civil lawsuit,generally follows the pattern of first punishment then civil ,along with incidental civil lawsuit mediation is restricted. In fact,the pattern of incidental civil lawsuit adopt first punishment then civil or first civil then punishment ,should be varied from case. Clearing criminal responsibility is not necessary Pre procedure criminal incidental civil mediation.
