Abstract
Criminal incidental civil action system has been built for long time in China,however more problems and disputes lie in it.We should improve present incidental civil action system.The cases should be applied to trial procedures with the different severity.Relative regulations on incidental civil action must be improved and the conflicts between it and civil law and the parts which are contrary to legal principles must be revised.It should be regulated to permit victims free from action in special situations or launch civil action before the case is settled.The traditional pattern of criminal priority should be changed and treated with parallel action.
