The globalizing of the economy impulses the globalizing of law.As one part of the globalizing of law,the reflection of the globalization of criminal law is every state learning each other on its criminal law,and international community affects the content of criminal law in every state by the way of making international pacts.The international current has been impelling the reformation of the legislation and the judicatory in our country.At present,the matter of human rights is the significant topic of the era and the whole world,so the idea of human rights protection has an outstanding appearance in our actual criminal law accompanying the course of the globalization of criminal law;at same time,the course exposes the serious faults of human rights protection system in our actual criminal law.To keep up with the globalization of criminal law,to think much of the idea of human rights protection and carry out it constantly,to perfect the criminal law in the aspects of fundamental principle,penalty system and order arrangement of specific provisions,only these will make the actual criminal law have the function that it should have.
