An Operational Analysis on Conflict of Laws and Choice of Law Rules in Administrative Litigation

Abstract

Conflict of laws in administrative litigation can be divided into legal conflict and illegal conflict.Legal conflict is allowed by the law and can be resolved by general choice of law rules.The law does not allow illegal conflict.So if one party to a conflict is in force,another must be not.Illegal conflicts are various and they endanger the rule of law.We must found some operational rules for choice of law in order to improve the judicial efficiency and justice.
