Abstract

Copyright law is usually considered as a private law,and its aim is to protect the interests of copyright holders.However,as the development of digital technology,as an exclusive right,copyright is being expanded;and correspondingly,as a system to restrict copyright,fair use system is becoming increasingly important.For one thing,the system of fair use can safeguard the access of copyrighted works,inspire knowledge and learning,and cultivate democratic culture;for another,public interest is the criterion to determine whether an act to exploit a copyrighted work is fair use or not.It poses important both academic meaning and practical value,from the perspective of public interest and analysis of the relationship between fair use and public interest.
