Abstract
To safeguard the suspect and defendant's human rights and promote judicial justice some improvement should be taken such as rigorous criminal evidence rule,criminal investigation procedure and defense system to guarantee the justification of criminal defense,scientific and rational judicial system and reasonably appliance in custody and no-custody precautionary measure and special criminal procedure.
