Abstract

That how to distinguish whether an accident belongs to a road traffic accident is a complicated problem in the practice of handling road traffic accidents. Four factors and three conditions in distinguishing traffic accidents are discussed by combining theories with practices. The necessary conditions to make up road traffic accidents and the basis to evaluate the degree of accident responsibility are analyzed to ascertain the responsibility of road traffic accidents. Finally, the relation between the responsibility of traffic accidents and legal responsibility is expounded.
