CONCILIATION OF THE PARTIES AND SETTLEMENT OF THE DISPUTE WITH THE PARTICIPATION OF A JUDGE AS ALTERNATIVE WAYS OF ADMINISTRATIVE DISPUTE RESOLUTION IN COURT

Abstract

Сливка М.М., к.ю.н., доцент, доцент кафедри адміністративного та інформаційного права Навчально-науковий інститут права, психології та інноваційної освіти Національного університету «Львівська політехніка» Сливка В.В., к.ю.н., адвокат Адвокатське об'єднання «АЙЕМ ПАРТНЕРС» Стаття присвячена дослідженню порядку примирення сторін та врегулюванню спору за участю судді в адміністративному судочинстві.Зазначено, що примирення сторін в адміністративному судочинстві дозволяє належним чином використати позитивний потенціал спору та узвичаїти вирішення публічно-правового спору в дружній (мирний) спосіб.Також примирення сторін в адміністративному судочинстві дозволяє зекономити часовий та грошовий ресурс сторін спору та суду.Поряд з цим, слід мати на увазі, що вже у підготовчому засіданні суд відповідно до вимог п. 2 ч. 1 ст.180 Кодексу адміністративного судочинства України (далі -КАС України) «з'ясовує, чи бажають сторони вирішити спір шляхом примирення або звернутися до суду для проведення врегулювання спору за участю судді.».Тобто, сторони спору можуть використати можливості вирішення спору шляхом примирення або врегулювати спір за участі судді вже на початковому етапі судового розгляду -у підготовчому засіданні.Водночас, треба пам'ятати, що у відповідності до ч. 5 ст.47 КАС України «сторони можуть досягнути примирення на будь-якій стадії судового процесу».З приводу економії грошових коштів, то з цього приводу зазначено, що у ст.142 КАС України закріплено правило, згідно якого вирішення справи шляхом примирення є підставою для того, щоби суд у відповідній ухвалі (чи рішенні) у відповідності до порядку, передбаченого законодавством, вирішував питання стосовно повернення позивачу (скаржнику чи заявнику) 50% судового збору, сплаченого ним при поданні позову (апеляційної чи касаційної скарги).Крім того, слід мати на увазі, що чим раніше сторони досягнуть консенсусу, тим менше суд витратить часу на розгляд справи.Наголошено, що примирення сторін в адміністративному судочинстві передбачає обов'язкову «легалізацію» досягнутих умов примирення, а саме затвердження таких умов судом, незалежно від того, чи був досягнутий сторонами спору консенсус з приводу умов примирення за участю судді чи без нього.Ключові слова: адміністративне судочинство, примирення, врегулювання спору за участю судді, мирова угода, сторони, публічноправовий спір, порядок примирення.The article is devoted to the study of the procedure for the reconciliation of the parties and settlement of the dispute with the participation of a judge in administrative proceedings.It is noted that the reconciliation of the parties in administrative proceedings allows to properly use the positive potential of the dispute and to settle the public legal dispute in an amicable (peaceful) way.Also, conciliation of the parties in administrative proceedings allows saving the time and money resources of the parties to the dispute and the court.Along with this, it should be borne in mind that already in the preparatory session, the court in accordance with the requirements of clause 2, part 1 of Art. 180 of the Code of Administrative Procedure of Ukraine (hereinafter referred to as the Administrative Court of Ukraine) «fi nds out whether the parties wish to resolve the dispute through conciliation or go to court to settle the dispute with the participation of a judge.»That is, the parties to the dispute can use the possibilities of resolving the dispute through conciliation or settle the dispute with the participation of a judge already in a preparatory meeting.Along with this, it should be remembered that in accordance with Part 5 of Art.47 of the Civil Code of Ukraine «parties can reach reconciliation at any stage of the judicial process.»Regarding saving money, it is stated in this regard that in Art.142 of the Civil Code of Ukraine establishes a rule according to which the settlement of the case through conciliation is the basis for the court, in the relevant ruling (or decision) in accordance with the procedure provided for by law, to resolve the issue of returning to the plaintiff (complainant or applicant) 50% of the court fee paid by him when fi ling a lawsuit (appeal or cassation complaint).In addition, it should be borne in mind that the sooner the parties reach a consensus, the less time the court will spend on the case.It is emphasized that conciliation of the parties in administrative proceedings involves mandatory «legalization» of the reached terms of conciliation, namely the approval of such terms by the court, regardless of whether the parties to the dispute reached a consensus on the terms of conciliation with or without the participation of a judge.
