Abstract

В статье рассматривается процесс расширения спектра преступлений, за совершение которых нормативными актами Русского государства XVI–XVII вв. (Судебником Ивана IV, Соборным уложением, Новоуказными статьями о татебных, разбойных и убийственных делах, иными грамотами и указами) предусматривалось тюремное заключение. Отмечается, что данная уголовная санкция применялась в качестве самостоятельного и дополнительного наказания, а также меры пресечения. Делается вывод о том, что увеличение числа преступлений, за совершение которых предусматривалось лишение свободы, отражало тенденции государственной политики, направленной на борьбу с преступностью в условиях усиления централизации власти. The article considers a process of expanding the range of crimes punishable by imprisonment in Russian normative acts of the 16–17th centuries, such as the Judicial Code of Ivan the Terrible, the Cathedral Code, New Decree articles on criminal, robbery and murderous cases, other charters and decrees. It is noted that this criminal sanction was used as an independent and additional punishment, as well as a preventive measure. It is concluded that the increased number of crimes for which deprivation of liberty was envisaged reflected trends of the state policy aimed at combating crime in conditions of increasing centralization of power.
