Совершенствование трудового законодательства Беларуси в рыночных условиях. К проекту нового Трудового кодекса. (Improving Labour Legislation of Belarus in Market Conditions. Towards the Draft of the New Labor Code.)

Russian Abstract: В статье опубликованы важнейшие выводы и другие результаты научного исследования по поводу создания первого в истории Республики Беларусь Трудового кодекса, направленного на обеспечение регулирования в рыночных условиях. Они составили основу авторской позиции при защите докторской диссертации на тему «Теоретические проблемы кодификации законодательства о труде Беларуси», осуществленной в том же 1996 году в Санкт-Петербургском государственном университете. Изложена краткая история подготовки проекта главного трудового закона страны в виде кодекса, раскрыта его концепция, охарактеризованы основные институты с их акцентом на работу в новых экономических реалиях. Значительное большинство высказанных в статье предложений нашло нормативное внедрение в 1999 г., когда Трудовой кодекс был принят белорусским Парламентом, одобрен Президентом и введен в действие с 1 января 2000 года. English Abstract: The article sums up the most important conclusions and other results of scholarly research which led to the creation of the first Labour Code in the history of Belarus regulating labour relations in market conditions after the collapse of the Soviet Union. They formed the basis of the author’s position in defending his doctoral dissertation on the topic “Theoretical problems of codification of labour legislation in Belarus”, which was also carried out in 1996 at St. Petersburg State University. A brief history of the preparation of the draft of the main labour law of the country in the form of a code is presented, its concept is outlined, the main institutions are described with their focus on working in new economic realities after the collapse of the Soviet Union. A significant majority of the proposals made in the article found a normative implementation in 1999, when the Labor Code was adopted by the Belarusian Parliament, approved by the President and enacted on January 1, 2000.
