Abstract

This chapter will further explore special issues and impacts in relation to the application of the patent law as a general norm to the pharmaceutical industry. Meanwhile, this chapter gives an overview of the special patent law issues involved in pharmaceutical patent. Above all, this chapter specifically concentrates on concepts quoted from PhRMA for an effective intellectual property system: 1. Provide fair and effective incentives for innovation - 2. Provide innovators certainty regarding their rights - 3. Offer patent holders strong enforcement tools for defending infringed patents.
