תקציר בעברית: המאמר עוסק בדילמות המלוות עורך דין דתי המייצג מיעוטי יכולת, בעיקר בני המגזר הדתי והחרדי, במסגרת דיונים בבתי דין פרטיים לממונות הפוסקים על פי ההלכה היהודית, בהתאם להסכם בוררות הנחתם בין הצדדים. הוא סוקר מקרה קיצוני לדוגמה אשר טופל על ידי הקליניקה לסיוע אזרחי על פי המשפט העברי, ואשר מעורר באופן חריף את הדילמות המלוות דרך קבע את עבודת הקליניקה. המאמר מציג את אופן פעולתם של בתי הדין ואת ההבדלים הקיימים ביניהם בפרוצדורה ובמהות. הוא מציג את יחסם ההלכתי השונה לחוקי המדינה, ואת עמדתם בנוגע לייצוג צדדים על ידי משפטנים. כן עומד המאמר על מספר דילמות עיקריות, ובמרכזן הקושי מולו ניצב עורך הדין הדתי אשר נושא זהות כפולה – מחד הוא חלק מקהילת המשפטנים הישראלית, וכלי עבודתו הינו המשפט המדינתי, ומאידך הוא אדם דתי המזדהה עם הרצון ליישם את המשפט העברי, להיות חלק מקהילה ולקבל את מרותה של הנהגה דתית. הוא מתלבט האם הסיכוי (הקלוש לעיתים) להשיג תוצאה משפטית שתיטיב עם הפונה הספציפי מצדיק שיתוף פעולה עם בתי דין אשר ממדיניותם ההלכתית הוא מסתייג, או שמא יש להתמקד בשיפור המערכת מבחוץ באמצעות הובלת תהליכי ביקורת וחקיקה. המאמר עומד בהקשר זה גם על גבולות הפלורליזם ביחס להליכים משפטיים אלטרנטיביים מקום שדומה שהם פוגעים בזכויות המוגנות על ידי כללי המשפט הליברלי. English Abstract: This article deals with dilemmas which accompany a religious lawyer who represents impoverished people, especially those in the religious and ultra-orthodox sector, in the framework of hearings in private courts for monetary disputes that rule in accordance with the Jewish Halacha in accordance with an arbitration agreement that was signed by both sides. The paper surveys, as an example, an extreme case that was handled by the The Civil Legal Aid Clinic in Jewish Law Tribunals, which sharply underlines the dilemmas which constantly accompany the work of the clinic. This paper displays the way the Jewish Law Tribunals act, and the differences between them in procedure and in essence. It shows the different Halachic attitudes they have towards Israel law, and their stand concerning the sides being represented by jurists. The article deals with several essential dilemmas which center on the difficulty a religious lawyer confronts in bearing a double identity. On the one hand he is part of the Israeli juristic community, and his tool is the state's law. On the other hand he is a religious person identifying with the desire to implement Jewish Law, to be part of the religious society, and to accept the authority of the religious leadership. He is undecided if the possibility (at times slight) to achieve legal results favorable to the specific applicant, justifies cooperating with a tribunal he has reservations concerning its Halachic policy. Or perhaps he should focus on improving the system from the outside by promoting criticism and legislation. The paper also deals with the limitations of pluralism in connection with alternative dispute resolutions where they appear to harm the rights protected by the rules of liberal justice
