The Implementation of the New Mental Health Improvement and Support of Social Welfare to Persons with Mental Illness Act and the Way to Support Persons with Mental Illness in the Process of Treatments, Admission to Psychiatric Hospitals and Discharge

2016년 9월 26일 헌법재판소가 구 정신보건법 제24조의 보호의무자에 의한 입원이 헌법에 불합치한다고 결정한 이래, 헌법재판소 결정 이전에 전면 개정되어 시행된 ‘정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률(이하 정신건강복지법이라 함)’ 제43조의 보호의무자에 의한 입원의 헌법합치성을 헌법재판소의 결정에서의 논리에 비추어 검토할 필요가 더욱 커졌다. 또한 정신건강복지법은 정신질환자의 비자의입원 요건을 매우 엄격하게 한 것의 정책적 함의를 인식하는 것도 중요하다. 이 글은 구 정신보건법이나 정신건강복지법의 보호의무자에 의한 정신병원 또는 정신요양시설에의 입원 또는 입소(이하 입원 등이라 함)가 공법 규정에 의한, 자유박탈적 효과를 수반하는 입원등이며, 부양의무자나 후견인의 민사법적 권한에 근거한 입원 등이 아님을 규명하였다. 따라서 폐쇄시설에의 입원 등을 통해 지속적으로 관찰할 필요가 있을 정도로 현재 또는 임박한 자해, 타해의 위험성이 있을 때에만 사회보호의 목적으로 한 비자의입원 등이 정당화될 수 있다는 점을 밝힌다. 이어 이 논문은 정신질환자의 비자의입원등의 요건을 엄격하게 함으로써 자의입원등, 개방시설에의 입원등, 지역사회에서의 치료로 전환하는 것에 정책적 목표의 중심을 두어야 한다고 주장한다. 이어서 법정책적으로는 정신질환자의 진단, 치료를 위한 비자의입원 등을 겪게 되는 정신질환자의 목소리가 비자의입원 절차에 반영되도록 해야 한다고 주장한다. 그 점에서 현행의 부양의무자나 후견인을 보호의무자로 하여 정신질환자를 지원하도록 하는 것은 여러 가지 점에서 부적절함을 밝히고, 대신 독립성과 전문성 있는 기관 또는 개인이 비자의입원의 전체 절차에서 정신질환자의 목소리를 대변하여 질환 치료에 관계하는 모든 사람에게 전달하는 것이 필요하다고 주장한다. Since the Constitutional Court decides, on 26th September 2016, that the involuntary admission of persons with mental illness to psychiatric hospitals and psychiatric institutions in accordance Article 24 of the Mental Health Act, which was totally revised in May 2016 to the Mental Health Improvement and the Support of Social Welfare to Persons with Mental Illness Act(hereinafter the revised Act), was incompatible with Article 12 of the Korean Constitution, it is indispensable to review the Artcle 43 of the revised Act in the light of the Constitutional Court decision mentioned above. After confirming that the involuntary admission according to article 43 of the revised Act as well as that of the previous Act is of a public law confinement, resulting in the deprivation of liberty, this paper argues that the assistance measure with which to facilitate of the persons liable to be subject to involuntary admission should be provided for; that otherwise the incompatibility of involuntary admission can hardly be cleared off. In this regard, this paper argues that persons with maintenance duty and guardians, on whom the public duty to protect the persons with mental illness are imposed by Article 39 of the revised Act, can in many cases be unsuitable persons for discharging that duty, because in many respects persons with conflicts of interests can be deemed as the very persons to protect those persons with mental illness, due to the lack of selection and suprvision process. Therefore this paper suggests that independent persons or bodies with expertise on mental illness and the human rights of persons with mental illness should be engaged as assistants to persons with mental illness to help them exercise their rights to treatments, admission and discharge. These independent mental health assistants can engage all persons involved in the process of treatment, admission and discharge of the persons with mental illness to perform their own role properly.
