The Political Dynamics Behind Consensual and Unilateral Model of Constitutional Amendments: 2000 French Reform and 1993 Russian Reform

Abstract

본 연구는 개헌안에 대한 컨센서스의 정도를 기준으로 하여 개헌의 유형을 합의형과 일방형으로 구분하고 이들의 정치적 동학을 비교정치적 관점에서 분석하였다. 개헌안에 대한 컨센서스가 큰 ‘합의형’ 개헌의 경우, 개헌과정의 아젠다의 수를 적게 하여 합의의 범위를 크게 하는 의제통제능력이 요구되며 거부권행사자의 수는 개헌의 여부에 큰 영향을 미치지 못하였다. 또한, 행위자들이 서로 개헌 성공의 공로를 주장하는 정치적 동학이 발생하게 된다. 프랑스의 2000년 사례에서 대통령의 임기단축에 대한 국민들의 여론이 매우 높았고 시라크 대통령과 사회당 다수의 의회가 이에 합의함에 따라 개헌의제를 단일한 이슈로 좁히는 방식으로 헌법개정에 성공하였다. 본 연구는‘일방형’ 개헌의 경우로 러시아의 1993년 헌법개정 사례를 분석하였다. 헌법개정을 둘러싸고 정상적인 국정운영이 불가능해질 만큼 심각한 정치적 대립과 갈등이 발생했을 때 힘의 균형이 변경되는 시점에서 광범위한 합의 없이도 지도자의 일방적 결단과 리더십 행사에 의해 개헌이 가능하게 되었음을 발견하였다.This study investigates the political dynamics behind constitutional amendments by making a distinction between a consensual and unilateral model of constitutional revisions. These two different modes of reforms entail a set of political mechanisms. Consensual reforms require broad agreement among both citizens and relevant political actors. Consensual reforms are more likely to be adopted when they are proposed as one-dimensional issues just as the 2000 French constitutional amendment on the reduction of the presidential term from seven to five years. Consensual reforms also are associated with credit-claiming strategies. By contrast, divisive reforms are linked with self-interested motivations since leaders are able to choose ‘unilateral reforms’ with narrow agreement. In 1993 Russia constitutional amendment, faced with political turmoil, a leader pushed the constitutional amendment based on the shift of a balance of power.
