Abstract

This Briefing Paper explains the risk associated with federal contractors' confidential compliance information being released pursuant to a Freedom of Information Act (FOIA) request, with particular focus on changes brought by the FOIA Improvement Act of 2016. To help mitigate those risks, the Paper also explains how contractors and their counsel can use FOIA Exemption 4 to protect against disclosure of confidential compliance information.
