บทคดยอ ตามบทบญญตของธรรมนญกรงโรมวาดวยศาลอาญาระหวางประเทศ (Rome Statute of the International Criminal Court) เขตอำนาจของศาลอาญาระหวางประเทศเปนไปตามกลไกหลกอำนาจเสรม (the principle of complementarity) ซงกำหนดใหศาลอาญาระหวางประเทศเสรมการใชอำนาจศาลในทางอาญาของศาลภายในของรฐ ตามหลกนศาลอาญาระหวางประเทศจะแทรกแซงเขาใชอำนาจศาลกตอเมอกระบวนการยตธรรมภายในของรฐลมเหลวในการสบสวนสอบสวนหรอฟองรองดำเนนคด ทงนตามหลกอำนาจเสรม ศาลอาญาระหวางประเทศจะไมรบคดไวพจารณาหากคดนนกำลงอยในระหวางการสบสวนสอบสวนหรอการฟองรองดำเนนคด หรอไดรบการสบสวนสอบสวนแลวโดยรฐทมอำนาจเหนอคดนน แตอยางไรกด ธรรมนญ กรงโรมฯ ไมไดใหคำนยามหรออธบายถอยคำวาอำนาจเสรมไวแตอยางใด สงผลใหในทางปฏบตเกดปญหาการตความ “คด” ทถกดำเนนคดโดยศาลภายในของรฐภายใตกลไกของระบบอำนาจเสรมน บทความนมงจะพจารณาเฉพาะในสวนของการปรบใชหลกอำนาจเสรมของศาลอาญาระหวางประเทศและการตความความเหมอนกน (sameness) ของ “คด” ตามระบบอำนาจเสรมของศาลอาญาระหวางประเทศตามแนวคำวนจฉยของศาลอาญาระหวางประเทศ เพอใหเกดความเขาใจทชดเจนมากขนเกยวกบการปรบใชหลกอำนาจเสรมของศาลอาญาระหวางประเทศในทางปฏบต ตอไป Abstract Under the Rome Statute of the International Criminal Court (ICC), the ICC jurisdiction is based on the principle of complementarity, which the Court shall complementary to national criminal jurisdiction. Regarding this, the ICC will step in to exercise its jurisdiction only when domestic courts fail to carry out the investigation or prosecution. According to this principle, the case is inadmissible when the case is being investigated or prosecuted or has been prosecuted. However, the Rome Statute does not provide explicit definitions of such phases. In practice, the ICC rules that the case before domestic court must be the same case as before the ICC. This article aims at analyzing the application of the principle of complementarity and the interpretation of the sameness of cases through the jurisprudence of the ICC for their better understanding.
