Abstract

The article is the result of normative and empirical research of this, discuss the regulation of contempt of court, law enforcement, and regulation of contempt of court in the criminal code bill. Based on research, the contempt of court has been regulated in the Criminal Code and Criminal Procedure Code. However, not many cases handled by law enforcement officials, because the formulation of the law does not explicitly mention the related contempt of court. That’s because no formal law regulating explicitly. While the criminal code bill which is being discussed by the Parliament and the Government contains provisions offenses to the judicial process adequately, covering criminal contempt of court and civil contempt of court. Therefore, it is an offense to the judicial process should not be regulated under a special law, but simply contained in the Bill, which needs to be synchronized with the Press Law and the Law on Advocates, and does not violate the right of people to express their opinions freely.
