The current pending system in China has the value orientation deviation,custody standard is simple,vague,the right configuration is not reasonable,custody measures is not independent,extended endures,the system is lack of relief way,such problems lead to that the judicial cost and social cost waste,which has caused custody abducts judicial,greatly restricts the independent exercise of jurisdiction,pending system reform is imperative.
